TERMS OF SERVICE
Effective date: 15 October 2026
1. Operator and agreement
MotionServ and the MotionServ Go application are operated by Webleap Tech, Navi Mumbai, Maharashtra, India. These terms govern your organisation's use of our hosted business software, website and associated applications. The person subscribing confirms authority to bind the organisation. Do not use the service if you do not accept these terms.
2. Accounts and authorised use
Provide accurate account and billing details, safeguard credentials and grant access only to authorised staff and technicians. Your organisation controls its users, roles, customers and service records. You are responsible for having permission to upload customer information, images, location and other personal data. Do not use the service for unlawful activity, unauthorised surveillance, malware, interference, access-control circumvention or infringement. The service manages field work; it does not replace professional judgment, emergency services or employment obligations.
3. Free trial and plan capacity
A new eligible organisation receives a one-time 15-day free trial without a credit card. The trial includes access to the platform subject to the displayed trial capacities, including five created service jobs and 25 customers under the current offer. It is not unlimited usage and does not repeat monthly. Reaching a capacity prevents additional records in that resource; existing permitted work remains available until trial expiry. Cancelled or deleted jobs do not restore consumed job allocation. Published plan and trial details at signup govern the applicable offer.
4. Subscription, price and taxes
Paid subscriptions are billed in advance for the selected monthly or yearly period. Yearly prices are charged as one yearly amount; a displayed monthly equivalent is illustrative. Displayed subscription prices include applicable taxes: no additional tax is added at checkout. Use the final checkout total and your payment document for the amount payable. Capacity limits and billing periods are shown before purchase. Job allocation resets monthly on the applicable billing anniversary even for yearly plans; unused allocation does not roll over unless expressly offered. Prices for future purchases or renewals may change with notice; existing purchased terms are not retroactively changed during the paid period.
5. Renewal, cancellation and refunds
Where a recurring mandate is authorised, the subscription renews through the payment provider until cancelled. You may stop future automatic renewal through Subscription & billing. Cancellation does not refund, credit or prorate the current paid period; paid access normally continues until its expiry. Deleting the app or ceasing use does not cancel a recurring mandate. See the separate Cancellation & refund policy. Subscription charges are non-refundable to the fullest extent permitted by applicable law; statutory rights and remedies that cannot lawfully be excluded remain unaffected.
6. Access limits and plan changes
Access to business modules may be restricted after trial or paid access expires, for unpaid renewal, or for security, unlawful use or a material breach. A record limit restricts creation for that resource, not all existing work during valid access. Immediate upgrades, scheduled changes and provider limitations are shown in the subscription flow; a change is effective only after provider confirmation. A failed payment or mandate authorisation alone does not establish a paid period.
7. Data, privacy and deletion
Your organisation retains its rights in the data it supplies. It authorises us and our service providers to process that data to operate, secure and support the service. Our Privacy policy and App privacy policy describe processing. Export information you require before requesting organisation deletion. Individual account deletion does not authorise deletion of another person's account or the organisation's business records. Deletion requests require identity and authority verification, and some records must be retained for legal, tax, security or dispute purposes.
8. Availability, third parties and responsibility
We use reasonable care to provide the service but do not promise uninterrupted or error-free operation, guaranteed GPS accuracy, guaranteed notification delivery or recovery of every offline action. Network, operating-system permissions and third-party payment or messaging providers affect operation. Maintain appropriate business controls and backups. No service-level commitment applies unless separately agreed in writing. Nothing excludes liability or consumer remedies that applicable law does not permit us to exclude. Subject to those rights, liability for ordinary contractual claims is limited to subscription fees paid for the affected service in the preceding 12 months; neither party is liable for indirect or consequential loss to the extent permitted by law. This limitation does not excuse fraud, wilful misconduct or liability that cannot legally be limited.
9. Changes and disputes
Material changes will be communicated through the service or account contact where practicable and apply prospectively. Indian law applies, subject to any mandatory local protection. Contact contact@motionserv.com first to seek resolution. Courts and competent statutory authorities having jurisdiction may hear disputes; these terms do not remove a right to approach a consumer forum or other authority.
